1. Acceptance of Terms

By purchasing, accessing, or using KRYOS hardware cold storage wallet and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use KRYOS products or services.

2. Description of Service

KRYOS provides a hardware device designed exclusively for secure offline storage of cryptographic private keys ("cold storage"). KRYOS includes:

• Hardware wallet device with Secure Element chip
• Companion software application (mobile and desktop)
• Documentation and support resources
• Firmware updates (when available)

4. User Responsibilities

By using KRYOS, you agree to:

• Safeguard your recovery phrase and never share it with anyone
• Maintain physical security of your KRYOS device
• Use a strong, unique PIN code
• Verify all transaction details before confirming
• Keep firmware updated when security patches are available
• Comply with all applicable laws regarding cryptocurrency
• Not attempt to reverse engineer, modify, or tamper with the device
• Not use KRYOS for unlawful purposes

5. Account Security and Recovery

You acknowledge and understand that:

• Your recovery phrase is the ONLY way to restore access to your private keys
• KRYOS cannot recover lost recovery phrases or reset PINs without the recovery phrase
• Loss of recovery phrase means permanent, irreversible loss of access to your assets
• You are solely responsible for backing up and securing your recovery phrase
• KRYOS will NEVER ask for your recovery phrase

6. Disclaimers and Limitation of Liability

6.1 No Warranty

KRYOS is provided "AS IS" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

6.2 Cryptocurrency Risks

You acknowledge that cryptocurrency transactions involve inherent risks including:

• Irreversibility of blockchain transactions
• Price volatility
• Regulatory uncertainty
• Network failures or forks
• Smart contract vulnerabilities

6.3 Limitation of Liability

KRYOS shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of funds or assets
• Loss of data or recovery phrase
• Device malfunction or failure
• Third-party actions or services
• User error or negligence
• Blockchain network issues
• Changes in cryptocurrency regulations

7. Intellectual Property

All intellectual property rights in KRYOS products, including but not limited to trademarks, patents, copyrights, trade secrets, and firmware, remain the exclusive property of KRYOS. Users receive a limited, non-exclusive, non-transferable license to use KRYOS devices and software.

8. Third-Party Services and Content

KRYOS may integrate with or reference third-party blockchain networks, protocols, and services. KRYOS is not responsible for:

• Availability, functionality, or security of third-party services
• Third-party terms of service or privacy policies
• Changes to blockchain protocols or networks
• Transaction fees charged by networks

9. Firmware Updates

KRYOS may release firmware updates to:

• Add support for new blockchain networks
• Implement security enhancements
• Fix bugs and improve performance
• Add new features

Firmware updates require physical confirmation on the device. Users are encouraged to keep firmware current for security reasons.

10. Warranty and Returns

KRYOS hardware devices come with a limited warranty covering manufacturing defects. The warranty does not cover:

• Physical damage from misuse or accidents
• Water damage (device is splash-resistant, not waterproof)
• Unauthorized modifications or repairs
• Normal wear and tear
• Loss of data or recovery phrases

For warranty claims, contact support@makerightdecision.com with device serial number and proof of purchase.

11. Export Controls

KRYOS products may be subject to export control laws and regulations. You agree to comply with all applicable export laws and not to export or re-export KRYOS to prohibited countries or individuals.

12. Termination

KRYOS reserves the right to discontinue support, services, or access to online features at any time, with or without notice. Your KRYOS device will continue to function as a cold storage wallet regardless of service termination.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or use of KRYOS shall be resolved through binding arbitration or in courts of competent jurisdiction.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and Legal Notice, constitute the entire agreement between you and KRYOS regarding the use of KRYOS products and services.
